These Terms & Conditions (“Terms”) govern your purchase of, access to and use of The Digital Creators Academy, including Creator Studio and related digital services (“Services”). In these Terms, “we”, “us” and “our” mean The Digital Creators Academy, and “you” means the customer or member using the Services.
By purchasing, registering for, accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
Separate licence terms may apply to specific resources, including The Vault. Where a separate licence applies, that licence governs use of those resources in addition to these Terms.
1. About the Services
The Digital Creators Academy provides online education, memberships, digital resources and Creator Studio tools intended to assist creators with planning, creating, editing, managing and selling digital and creative products.
Creator Studio features may include:
- AI image generation and image editing;
- clipart, illustration, mockup and product-image generation;
- prompt creation and saved prompt tools;
- Etsy listing, title, description, keyword and tag assistance;
- background removal, image upscaling and other image processing;
- pricing, profit and business calculators;
- calendars, planners, roadmaps and business-planning tools; and
- other creator tools introduced from time to time.
The Services are evolving. We may add, improve, replace, restrict or discontinue features as reasonably necessary.
2. Eligibility and Accounts
You must be at least 18 years old to purchase or independently use the Services, or otherwise have the permission and supervision required by applicable law.
You are responsible for maintaining the security of your account and login details. Access is intended for your individual use unless we expressly state otherwise.
You may not sell, transfer, sublicense or share your account access with another person. We may restrict or suspend accounts where we reasonably believe account sharing, fraud, abuse or unauthorised access has occurred.
3. Membership Access
Access to Creator Studio and other Services may depend on your membership tier or the product you purchased. Different tiers may include different tools, resources, monthly allowances, credits, generation limits and benefits.
If the membership providing your access is cancelled, expires, refunded or otherwise ends, access to membership-only features may also end.
We may change the contents of membership tiers as the Services develop. Where required by applicable law, we will provide appropriate notice of material changes affecting an existing paid subscription.
4. Skool and Other Third-Party Platforms
Some memberships, community features or payments may be provided or managed through Skool.
Skool is an independent third-party platform and is not owned or operated by The Digital Creators Academy. Your use of Skool is also subject to Skool’s own terms, privacy policy, payment terms, community standards and other applicable policies.
Where you purchase or manage a membership through Skool, certain matters relating to billing, subscription administration, cancellation, refunds or your Skool account may also be handled by or subject to Skool.
These Terms continue to govern your use of The Digital Creators Academy and Creator Studio regardless of whether access is obtained through Skool or directly from us.
5. Pricing and Payments
Prices, billing frequency and included benefits will be displayed at or before purchase. Prices may change for future purchases or renewals, subject to any notice requirements under applicable law.
You are responsible for providing accurate billing information and for any taxes or charges that lawfully apply to your purchase.
Payments may be processed by third parties such as Skool, Stripe or another payment provider. Their own terms and privacy practices may apply to payment processing.
6. Creator Studio Credits
Certain Creator Studio tools use credits. Credits are an internal usage allowance for eligible Creator Studio actions. They are not money, stored monetary value, cryptocurrency or any other financial instrument, and they cannot be exchanged for cash.
Different actions may require different numbers of credits depending on the tool, processing requirements, resolution, AI model or provider, quality level, technical cost or third-party provider pricing.
We may reasonably adjust the number of credits required for particular tools as technology, functionality or provider costs change. Where practicable, the required credit amount will be displayed before processing.
7. Included and Purchased Credits
Eligible memberships may include a recurring credit allowance. Membership credits have no cash value, may not be sold or transferred, and are subject to the rollover or expiry rules displayed with the applicable membership.
Where available, additional credit packs or top-ups may be purchased. The price and quantity will be displayed before purchase. Purchased credits may only be used for eligible Creator Studio services.
8. Digital Purchases and Refund Policy
Digital purchases are generally non-refundable once the relevant digital content, access, credits or digital service has been supplied or commenced, except where applicable law gives you a mandatory right to cancel, a refund, price reduction or another remedy.
This general non-refundable policy may apply to:
- Creator Studio credit packs and top-ups;
- downloadable digital products and resources;
- courses and educational materials;
- immediate-access digital content;
- AI generation and image-processing services already supplied; and
- other digital products or services delivered or commenced following purchase.
Please review the product description, price, membership information and purchase details carefully before completing your purchase.
Where the law requires your express consent or acknowledgement before digital content or services begin immediately, we may request that consent or acknowledgement during checkout or registration.
Nothing in these Terms excludes or limits rights that cannot lawfully be excluded, including remedies that may apply where digital content or a digital service is faulty, not supplied, not as agreed, or otherwise does not meet mandatory legal requirements.
9. Credit Use, Failed Generations and Processing
Credits that have been successfully used to generate, edit, upscale, remove a background from, process or otherwise create content are generally not refundable merely because you change your mind or do not like the result.
AI-generated results are inherently variable. A completed generation that does not match your personal preference is not automatically treated as a technical failure.
Where our systems can verify a technical failure, we may restore the relevant credits, retry the request or route the request through an alternative provider without charging you twice for the same requested action.
10. Subscription Cancellation
You may cancel a recurring membership using the cancellation method provided for that membership. Cancellation normally stops future renewal and does not retrospectively cancel a paid period that has already begun, subject to any mandatory rights available under applicable law.
Where you purchased through Skool or another third-party platform, cancellation and refund processing may also be subject to that platform’s procedures and policies.
11. Consumer Rights
Nothing in these Terms removes, restricts or overrides any consumer right that cannot legally be excluded.
Depending on your location and the circumstances of the purchase, consumer law may provide rights relating to withdrawal, cancellation, conformity of digital content or services, repair, replacement, price reduction, termination or refunds. Where those rights apply, they continue to apply despite our general non-refundable digital purchase policy.
12. AI-Generated Content
Creator Studio may use artificial intelligence to generate images, text, prompts, product listings, titles, descriptions, keywords, tags and other material (“AI Output”).
AI systems are probabilistic. Results may vary even when the same or similar instructions are submitted.
We do not guarantee that AI Output will be unique, error-free, accurate, suitable for a particular commercial purpose, copyrightable, registrable as a trademark, non-infringing, accepted by a marketplace, or identical in quality or style between generations.
You are responsible for reviewing AI Output before publishing, distributing, relying on or selling it.
13. Commercial Use of AI Output
Subject to these Terms, applicable law and any applicable third-party provider restrictions, AI Output generated through Creator Studio may be used for personal or commercial purposes.
Commercial uses may include digital products, physical products, print-on-demand products, templates, invitations and stationery, marketing materials, websites, social media content and other products offered for sale.
Permission to use an AI Output commercially does not guarantee that copyright, trademark or other intellectual property rights exist in that Output. You remain responsible for ensuring your intended use is lawful.
14. Ownership and Non-Exclusivity of AI Output
As between you and The Digital Creators Academy, we do not claim ownership of AI Output generated specifically by you through your Creator Studio account.
AI-generated content may not be unique. Other users of Creator Studio or other AI services may receive identical, similar or conceptually related outputs.
Generating an Output does not automatically give you exclusive rights over its underlying style, idea, concept, subject matter or other unprotectable elements.
15. Your Uploads and Reference Material
Creator Studio may allow you to upload images, photographs, artwork, designs, text, documents or other materials (“User Content”). You retain your rights in your User Content.
By uploading User Content, you authorise us to process and transmit it as reasonably necessary to provide the service you requested, including transmission to relevant third-party technology providers.
You confirm that you own the User Content or have the rights and permissions necessary to upload, process and use it.
You must not upload content that unlawfully infringes another person’s copyright, trademark, privacy, publicity or other rights. You should not upload another creator’s work and request substantially identical commercial artwork unless you have the necessary permission or legal right to do so.
16. Third-Party AI and Technology Providers
Creator Studio relies on third-party technology. Providers may include OpenAI, Google, Recraft and other AI, image-generation, image-processing, hosting, authentication, payment or infrastructure providers selected by us from time to time.
Creator Studio may automatically change or select the provider used to complete a particular request. For example, if a primary background-removal, upscaling or image-generation provider is unavailable, a request may be routed to an alternative provider.
Use of a third-party technology may additionally be subject to that provider’s applicable terms and policies.
17. Third-Party Service Availability
We do not control the availability or performance of independent third-party APIs, AI models or services. Providers may experience outages, impose limits, change pricing or policies, modify or discontinue models, or withdraw functionality.
We may replace providers, models or processing methods where reasonably necessary to maintain or improve Creator Studio. We do not guarantee permanent availability of any particular model, provider or feature.
18. Prohibited Use
You must not use the Services to create, upload, process or distribute unlawful content or to facilitate unlawful activity.
- Do not unlawfully infringe copyright, trademark, privacy, publicity or other rights.
- Do not use the Services for fraud, harmful deception, unlawful impersonation, harassment or threats.
- Do not upload unlawful exploitative material.
- Do not bypass credit requirements, usage restrictions, access controls or security safeguards.
- Do not exploit technical errors, manipulate balances or create multiple accounts to evade restrictions.
- Do not use excessive automation or scraping in a way that interferes with the Services or circumvents normal limits.
19. Copyright, Trademarks and Third-Party Rights
The ability of an AI system to generate a brand, fictional character, celebrity likeness, logo or other protected material does not mean you have permission to sell or commercially exploit that material.
You are responsible for ensuring that your prompts, uploads and resulting products comply with applicable intellectual property law. We do not grant permission to use third-party intellectual property merely because Creator Studio generated it.
20. Etsy and Other Marketplaces
The Digital Creators Academy and Creator Studio are independent services and are not affiliated with, endorsed by or sponsored by Etsy or any other marketplace unless expressly stated.
Tools relating to Etsy listings, pricing, SEO, titles, descriptions, keywords or tags are provided as assistance only. We do not guarantee search rankings, traffic, sales, conversion rates, marketplace approval, profitability or any particular business result.
You are responsible for checking and complying with the current rules, fees and policies of each marketplace you use.
21. Pricing, Profit and Business Tools
Any calculator, forecast, pricing suggestion, fee estimate or other business-planning output is provided for informational purposes only and is not financial, accounting, tax or legal advice.
Fees, taxes and marketplace charges may change. You should independently verify information that is important to your business decisions.
22. AI-Generated Listing and SEO Content
Creator Studio may generate titles, descriptions, tags, keywords and other listing content. These are suggestions and must be reviewed before publication.
Unless expressly stated, we do not guarantee that a generated keyword has a particular search volume, ranking potential or conversion rate. You are responsible for accuracy, relevance, intellectual property considerations and marketplace compliance.
23. Service Changes and Fair Use
We may add, modify, replace or discontinue tools, models, interfaces and functionality as the Services evolve.
Creator Studio is intended for normal individual creator and small-business use. We may introduce reasonable usage limits to maintain performance, manage third-party restrictions, control excessive automated usage, prevent abuse or maintain the commercial sustainability of the Services.
24. Suspension and Termination
We may suspend or terminate access where we reasonably believe a user has materially breached these Terms, committed fraud, abused the Services, circumvented usage or credit systems, shared account access without permission, repeatedly breached provider policies or created a material legal or security risk.
Where appropriate and reasonably possible, we may provide notice or an opportunity to resolve the issue. Mandatory consumer rights remain unaffected.
25. No Guarantee of Business Results
The Services are intended to assist creators. We do not guarantee sales, revenue, profitability, successful products, marketplace ranking, audience growth, customer acquisition or any particular business outcome.
You remain responsible for your business decisions and results.
26. Disclaimers and Liability
To the maximum extent permitted by applicable law, Creator Studio is provided on an “as available” basis. Artificial intelligence may produce unexpected, inaccurate, incomplete or unsuitable results.
Nothing in these Terms excludes or limits liability, warranties, remedies or consumer protections where doing so would be unlawful.
To the maximum extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from use of the Services, including anticipated profits, revenue or business opportunities, or losses caused solely by independent third-party outages or changes outside our reasonable control.
27. Privacy
Use of the Services is also subject to our Privacy Policy. Creator Studio may process account information, prompts, uploaded content and other information necessary to provide requested services. Where a feature requires a third-party provider, relevant information may be transmitted to that provider as described in our Privacy Policy.
28. Changes to These Terms
We may update these Terms as our Services, technology providers, business model or legal obligations change. The current version will be made available through our website.
Where required by applicable law, we will provide appropriate notice of material changes affecting an existing paid service or your legal rights.
29. Governing Law
These Terms are governed by the laws of Ireland.
If you are a consumer residing in another jurisdiction, you may also benefit from mandatory consumer protections that apply to you. Nothing in these Terms deprives you of mandatory rights that cannot lawfully be excluded.
