5. Legal Bases for Processing
Performance of a contract
We may process personal data where necessary to provide a product, membership or service you requested, including account access, generation requests and image-processing functions.
Legitimate interests
We may process data where necessary for legitimate interests such as operating and improving our Services, maintaining security, preventing fraud, protecting our business and understanding service performance, where those interests are not overridden by your rights and interests.
Legal obligations
We may process and retain information where necessary to comply with legal, tax, accounting, regulatory or law-enforcement obligations.
Consent
Where required, we may rely on your consent, for example for certain marketing communications or non-essential cookies. Where processing relies on consent, you may withdraw it at any time without affecting processing carried out before withdrawal.
6. Creator Studio, AI and Image Processing
Creator Studio uses third-party artificial intelligence and image-processing technologies. When you request an AI-powered or image-processing function, information necessary to perform that request may be transmitted to the relevant provider.
Depending on the feature, this may include:
- prompts and written instructions;
- uploaded or reference images;
- designs or graphics;
- text submitted for processing; and
- technical information needed to complete or troubleshoot the request.
We aim to transmit only information reasonably necessary to provide the requested function.
7. AI and Technology Providers
Depending on the features you use, Creator Studio may use providers including OpenAI, Google, Recraft and other AI, image-generation or image-processing providers selected by us from time to time.
We may change providers as Creator Studio develops or route requests to an alternative provider where a primary service is unavailable.
Where a provider processes personal data on our behalf, we take appropriate steps to address data-protection requirements applicable to that relationship. Some providers may also process information as independent controllers for limited purposes described in their own terms or privacy documentation.
8. Uploaded Images and Other User Content
Images and other material uploaded to Creator Studio may need to be temporarily stored, transmitted or processed to provide the requested service.
For example, an image submitted for background removal must be sent to the relevant image-processing provider, and a reference image submitted for generation may need to be transmitted to the relevant AI provider.
We do not claim ownership of your uploaded content merely because it is processed through Creator Studio.
Please avoid uploading personal data that is unnecessary for the requested function, particularly sensitive or highly confidential personal information.
9. Skool
Some memberships and community functions may be provided through Skool. Skool is a separate third-party platform and may independently collect and process personal data under its own privacy policy and terms.
We may receive information from Skool where necessary to verify or administer membership, provide access to our Services, reconcile subscription status or provide customer support.
Your direct use of the Skool platform is subject to Skool’s own privacy practices.
10. Payments
Payments may be processed by third-party providers such as Skool, Stripe or another payment provider.
Payment providers may collect information such as your name, billing details, transaction information and payment-card information. We generally do not receive or store your complete payment-card number where payment details are processed directly by the payment provider.
Payment providers process personal data in accordance with their own privacy notices and applicable law.
11. Hosting, Website and Other Service Providers
We may use service providers for website hosting, databases, authentication, email delivery, backups, security, analytics, content delivery, customer support and other technical or business functions.
These providers may process limited personal data where necessary to provide services to us.
12. Sharing Personal Data
We do not sell personal data.
We may share personal data where reasonably necessary with:
- AI and image-processing providers;
- hosting and infrastructure providers;
- membership and community platforms such as Skool;
- payment processors;
- authentication and security providers;
- email and communication providers;
- analytics providers, where permitted;
- professional advisers such as accountants, insurers or legal advisers; and
- public authorities or regulators where disclosure is required by law.
We seek to limit disclosures to information reasonably necessary for the relevant purpose.
13. International Data Transfers
Some providers may process personal data outside Ireland or the European Economic Area (EEA).
Where GDPR transfer restrictions apply, we take appropriate steps to use a lawful transfer mechanism where required, such as an adequacy decision, Standard Contractual Clauses or another recognised safeguard.
14. Data Retention
We retain personal data only for as long as reasonably necessary for the purposes for which it was collected and to satisfy legal, accounting, tax, security, fraud-prevention and dispute-resolution requirements.
Different categories of information may have different retention periods. Account and transaction records may need to be retained after a membership ends where required by law or for legitimate business purposes.
Prompts, generated content and uploaded files may have different retention periods depending on the feature and technology provider involved. Where appropriate, temporary processing files may be deleted once they are no longer needed.
15. Data Security
We use reasonable technical and organisational measures designed to protect personal data against unauthorised access, loss, misuse, alteration, disclosure and destruction.
No online service or electronic storage method can guarantee absolute security. You are responsible for keeping your account credentials secure and should contact us if you believe your account has been compromised.

These rights are subject to applicable legal conditions and exceptions. We may need to verify your identity before responding to certain requests.
To exercise a data-protection right, contact: hello@thedigitalcreatorsacademy.com
17. Complaints
If you are in Ireland, you may lodge a complaint with the Irish Data Protection Commission if you believe your personal data has been processed in breach of data-protection law.
You may contact us first so we have an opportunity to address your concern, but doing so does not affect your right to contact the supervisory authority directly.
18. Marketing Communications
Where permitted by law, we may send information about The Digital Creators Academy, Creator Studio, products, resources or memberships.
Where consent is required, we will obtain it. You may unsubscribe from marketing emails using the unsubscribe facility provided or by contacting us.
Service communications relating to your account, payments, security or important membership matters may still be sent where necessary even if you opt out of marketing.
19. Cookies and Similar Technologies
Our website may use cookies or similar technologies for essential functionality, login, security, preferences, analytics and, where applicable, marketing.
Where legally required, non-essential cookies will not be used until the required consent has been obtained. You may be able to manage preferences through our cookie consent tool.
A separate Cookie Policy or cookie notice may provide more detailed information about the cookies and technologies in use.
20. Children’s Privacy
Our Services are primarily intended for adults and business creators. We do not knowingly seek to collect children’s personal data where doing so would be unlawful.
If you believe a child has provided personal information to us without appropriate permission, please contact us.
21. Automated and AI Technology
Creator Studio uses automated and AI systems to generate or process content at your request.
These creative and productivity tools are not intended to make legal or similarly significant decisions about individuals.
22. Third-Party Links
Our Services may contain links to third-party websites or services. We are not responsible for the privacy practices of independent third parties. We encourage you to review their privacy information before providing personal data.
23. Changes to This Privacy Policy
We may update this Privacy Policy as our Services, providers or legal obligations change. The latest version will be published on our website with an updated “Last updated” date.
Where required by law, we will provide additional notice of material changes.
